The Ugly Usurpation

There are two types of power in government. One type is based on trust and is delegated…the other is just assumed.

Obamacare is a case of assumed power, not legitimate law, and regardless of what five misguided justices recently opined, our Constitution clearly forbids the federal government from assuming power from the people.

Thanks to decades of progressive education, media propaganda, and politicians from both parties that have ignored their oaths to uphold our US Constitution, we may now say we are nearly de-constituted as a country that once was based on individual freedom and our property rights, in a society which both revered and observed the rule of law.

We the Central Authority of the Subservient States, in Order to form Enduring Powers, establish arbitrary Justice, insure domestic Obedience, provide for the Social Compact, promote the Standardized Consensus Agenda, and to secure and redistribute the Property of the Demos, do command, and so order, this Manifesto as Supreme authority over the subjects of the Socialist States of America from this time forward.

Far fetched? Which part is not already true?

Our federal government, populated and dominated by socialist ideologies, is dictating what the states may or may not do, as well as us citizens, as if we were subjects commanded to obey, instead of the source of our elected representatives authority. This dictating attitude of office holders is heard in their words, and seen through their actions.

The Rule of Law, along with the elements that are required for true justice, have been usurped by the rule of men. The laws have grown so numerous, and so complex as to not be known even generally, much less in any specifics by most of the people. Increasingly we see these laws are applied unequally, to politically favored groups for either exemption or benefit, and to dis-favored groups as punishments and inhibitors of freedom. Not only is the individual left largely unprotected now in favor of the arbitrary “greater good” of society, new laws are damning to the individual… and his rights. Success of the productive is often met by confiscation, overbearing regulation, and even more laws of men which are meant mainly to siphon off a maximum value for the longest time possible, and redistribute those proceeds to ensure political power for themselves. Judicial review is no longer conducted by impartial or independent judges.

Irresponsible social promises have been made now for generations, by those willing to promise anything, without being held responsible for their false advertising, which in turn has made the notion of a ‘social compact’ between the government and the people seem almost natural for people to expect, and many feel this promised arrangement is somehow superior to the idea of true self sufficiency and the liberty to pursue ones own happiness. Evidently these people have never thought it through far enough to realize that one cannot both retain responsibility for determining one’s own path, and simultaneously enjoy no responsibilities for their own welfare.

If we are to retain our ability to demand our consent for a system of self-government, as a representative Republic, we must elect those that understand the elements of good law to be our lawmakers. Otherwise we end up with the rule of men, uncertainty, decline, and worst of all, the end of our liberty.

Our Founders understood what the Rule of Law consists of. Our elected officials need to remember these elements too. The rule of law must be known (knowable) in general to all, have a certainty (a law we count on to last without changing, and have a sound legal framework. It must be applied with equality, with an absence of any government discretionary power which always threatens the Rule of Law. It must have impartial independent judicial review. It must acknowledge its authority is only derived by protecting our individual rights.

The recent Obamacare law is a prime example of what happens when the Rule of Law has been eviscerated and usurped by the arbitrary rule of men. It is an unprecedented massive, unknowable law that was both rushed and rammed through Congress by a majority against the will of the people, which tramples on individual rights, is already undergoing numerous changes, will generate volumes of new rules, is creating uncertainty, is full of both discretionary powers by government and exemptions for government and others of favored status, and much of it is not subjected to any independent judicial review or even congressional review. Life itself will be put at risk by its provisions, which do include a “death panel” based on costs of services.

So we can see that the fictitious Preamble of the De-constituted above is not far fetched at all. This is however how those in power now exercise their duties. This is the power and purpose they are actively seeking by any means possible, and they likely hope to pronounce a similar manifesto of control when they know that they have crushed any resistance to them. They have massively abused their power to the point of controlling us, by ignoring good law, constitutional constraints to limit power, the sovereignty of the individual, and substituting arbitrary rules of their own making. All the positive good born of freedom which our fellow citizens, current and past, have built upon to grow this society into the greatest country, is now in jeopardy of being lost forever unless we end this rogue regime of post constitutionalists and any like it.

It is not too late though, unless of course, We the People ignore what Edmond Burke stated;

“All that is necessary for evil to triumph is that good men (and women) do nothing”

We the people of the United States, in order to form a more perfect union, establish justice, insure domestic tranquility, provide for the common defense, promote the general welfare, and secure the blessings of liberty to ourselves and our posterity, do ordain and establish this Constitution for the United States of America.

The Rarest Thing In Washington D.C.

While it is true that honesty, integrity, common sense, or ethical behavior seem rare these days in Washington, D.C., there is another glaring rarity that is so obvious that most cannot see it.  Those that are the closest, who work there, are the least likely of all to see.

In fact, it may require some distance to observe this basic truth. For the further away one is, the more likely one is to suffer ill effects due to the very rarity of this entity.

The rarest thing in Washington is a product this country needs the most.

What is it that is so rare?

The rarest thing created in Washington, D.C. is… good law.

On one hand we should recognize and respect these people for the sacrifice they make in serving us, but on the other we deserve much better. Lawmakers there have a nearly impossible task given the scope of the role most of them now believe they own. Logistically, they just do not have time to construct good law.  They no longer seem to understand their job descriptions as decreed by the people. Who can blame them though, with the federal courts continuously handing out findings that seem to indicate we have moved beyond our Constitution, in the name of progress, which leads them to believe in an ever expanding role for themselves, and the part they must play? Great cover, having unelected activist judges provide the “business of Washington” rules. They also believe that they are primarily there to make law, so they go about making multitudes of new laws for us all to follow.  And therein lays the problem. Hundreds of new laws, and tens of thousands of new rules to enforce them are created by them yearly. And their product is not very good. Have you looked at our federal tax laws?

Since we citizens are not all the same, and have such a wide variety of differing needs and interests for ourselves and communities, making laws to be applied equally to everybody across the land is no small design challenge. And the fact of the matter is, the design challenge is rarely ever met at all.

As an analogy imagine trying come up with a sound bridge design which must accommodate all the people, all the time, and handle any and all contingencies, and also be safe, and do this in a few days, weeks, or even months. In fact, such a bridge would be nearly impossible to even design or to make, ever.

Any such undertaking of this magnitude should also be rare.  But this is not what happens in Washington, D.C.. What happens there is that reams of new “problems” are brought to a lawmakers attention, and he or she is expected to come up with equitable solutions.  So they go about the process of making new laws via the bill procedures. After all they are called “lawmakers.”

Originally, when the elected adhered to our Constitution and understood their job, lawmakers were supposed to congregate in our U.S. capital to decide on important solutions primarily concerned with protecting the citizenry from external threats to their lives, liberty, pursuit of happiness and property.  They then returned home to report to their constituents and state legislators. When Congress stuck to those actual responsibilities, they had far fewer laws to make than what they undertake now, and they actually had a chance to design and construct good laws. Somewhere along the line however, they decided that they were really there to decide for us citizens what to do about anything and everything. Having given themselves authority they do not have, they are now overwhelmed by it.

Today a “problem” is more likely to be a “special interest” or ideological wish list, rather than any actual national distress or threat needing a new law for a solution.  The lobbyist who represents money…

Mutiny on “The Bounty”

Are we really rudderless?

If we look at America as a ship on a journey of destiny, through the seas of time, we can see that our ship of bounty is not by any means rudderless. Likewise the tea party movement is not rudderless either. America is a beautiful and complex ship with incredible power and equally incredible grace. Those that man the various stations that make her go are some of the best educated, most innovative, hard working and loyal people the world has ever had. The systems that make her go are the best ever designed for any journey near or far. They have performed superbly from her launching well over two centuries now.

Lately though our ship has began to falter, our engines are overtaxed, our fuel starved by some rather perplexing orders issued by a new officer corps over the last few decades. Our great ship has altered her course and headed off to some very troubled waters. In addition to the problems brewing within her bowels she has become a target designated for destruction by others.

On board her magnificent decks there are opposing factions that have worked well in times past to check and double check the actions of all to make sure that the proper and necessary procedures were adhered to to insure the integrity of the ship so we could safely navigate the stormy seas that compose the worlds history. So successful has this journey been that it is the envy of the entire world, and has spawned both awed admirers and jealous hatred alike.

However those who have ridden and lived their lives aboard have found liberty, freedom, reward, and happiness so long as they have maintained a respect for the integrity of her systems. Others have become disenchanted with the intended functions of her systems and make specious claims they are outdated, and the results of breaching the interlocks on our systems are beginning to have catastrophic results. The operating instructions were corrupted, the training too, the redesigns were constantly slipped in, and those who had redesign in mind seized power from those who wished for the integrity to be maintained. The results are that our engines are working much harder now, our fuel starved, and our boat is overladen and stressed to a breaking point.

Our troubles are many and to compound this hideous situation we are being steered straight into further trouble. Our systems may soon be beyond repair. We may be unable to change course, lose most of or all of our propulsion and lose any ability to institute any independent damage control. The ship is listing badly to the left.

The good news is that traditionally there are many more in the faction that believes in the integrity of our systems than there are who are instituting the redesigns. They may be able to save our ship yet. But how?

The redesigns control everything now. They control the officer promotion system and will use any means possible to keep that power. They hold all the key positions to steer and manage the power of the ship too. They control the procedures and the publications for running the ship and they control the fuel.

The ships communications network is vital to both the re-designers and the traditionalists. The messages are in conflict. The re-designers would have all on board believe that their redesigns are working splendidly and that not only is everything fine, it is much better, and will be very apparent once all the old thinking is gone.

The rest of the crew knows better. They have seen many such ships with the same ill designs wrecked on the rocky coasts of history. The rest of the crew are those that have now joined the tea party movement or will soon.

Our movements rudder is our shared knowledge of the integrity of systems designed superbly to work in harmony by limiting the power of those at the helm to redesign any of them. We are the engines of our ship. Our fuel is our way of life which is based on our God given rights of life, liberty and the pursuit of happiness.

The officers of our ship have hijacked us, they are the pirates that seek to rob us of our choices and still think we will be their engines. They pretend to know of calmer waters and a better way forward, but they do not.

Re taking control of our ship is vital now. Being able to restore the integrity of our systems is also vital but will take much longer to repair. The pirates are guarding against both. They are trying to make their changes irreversible. They have just begun to employ techniques that will drown out any protests to their actions.

We do have a Captain for our ship, and all have sworn to obey this captain. Only those who actually are doing this are worthy of our loyalty and those that usurp our Captain’s authority need to be forever demoted, and never again be entrusted with any delegated power received by the people of our ship. All the pirates must be removed.

Our Captain is the US Constitution, and it is up to us to demand that only this steerage ever be used to guide our ship with Gods blessing and protection.

When Will President Obama Make the Case for Freedom?

It is important, likewise, that the habits of thinking in a free country should inspire caution in those entrusted with its administration, to confine themselves within their respective constitutional spheres, avoiding in the exercise of the powers of one department to encroach upon another. The spirit of encroachment tends to consolidate the powers of all the departments in one, and thus to create, whatever the form of government, a real despotism. The case for freedom is America.

Millions seek to come here for that reason alone!

Appreciative Americans realize that and thank God that they were fortunate enough to be either born here, or become a citizen here.

Millions more around the world live without freedom, but hope to experience it someday.

It does not take a whole lot of education to understand that we are blessed, while others are not so fortunate.

Obama is exploiting the difference for his own political purposes.

Past presidents have shown the world what freedom  offers, and encouraged people from around the globe to not only consider freedom, but to strive for it.

America is not a selfish nation.  We have never felt that freedom and liberty was solely our domain to jealously guard without sharing.

So why now is our president acting as if that is the case?  Why does he travel  to places devoid of any true freedom- and state we are standing on common ground?

Just when exactly is he going to start to speak the truth about the way things really are?

People that live under freedom live the best, period.  They have the most, need the least as far as basic survival and in quality of life.

People that live under powerful thugs or where an elite political class controls everything have the least, and need the most.

Our freedom grew out of our economic freedom, that is how we became the superpower we are compared to other nations. That superpower status does not just refer to military might, it applies across the categories of human endeavors.

Innovation, generosity, justice, compassion, and economic might.

Our freedom enabled us to become who we are.  We are free to speak, to worship, to own property and to have a representative government.

Our freedom has created such a powerful momentum that we have been propelled along by this even as many have worked tirelessly against our rights and freedom.

Now though, all those chips and cracks against our principles, by so many, for so long, are really taking a toll on our Charters of Freedom, the Declaration of Independence, and the U.S. Constitution.

I do not see  or hear our president making the case for freedom at all.

In fact, I am not alone in believing,  that the president has actually been making the case against freedom everywhere he goes,  with both words and deeds.

We can easily find apologists and defenders alike that insist that we, whom cherish our freedom, have judged the president all wrong.

They call us “extremists” as they work feverishly to deny all religious worship as the work of “zealots” if it does not conform to their worship of the State.

They call us “fringed elements” while they work ingeniously to disguise their attempts to stifle and suppress speech that does not conform to their views.

As they seize control over private industries right and left, they claim free enterprise is the evil in our country.

They openly admit to plans to further deprive of us our freedoms and how they will spend a lot more money we do not have, to make energy unavailable for use, to punish those with special sentences for daring to think for themselves about social issues, and to openly flood our society with workers they know will vote for entitlements over freedom.

Not only is our free economic system being dismantled without regard to freedom, our personal freedom is also under attack.

Our Constitution guarantees the right to own and bear arms an essential right in a free society, yet Obama has not been straight with America, and does seek to disarm us.

Nothing can be more personal than seeking and having control over your own health care decisions, and also maintaining your privacy as an individual, so why than is Obama pushing so hard to to seize these personal rights and personal freedoms away too?

How can society be free if they have no say in their lives?

I do not know exactly why our media threw in so completely with the anti-freedom, pro-control left.  It is bad for us all (that love freedom) that they have chosen this.

Most of us can appreciate and understand the special role and rights afforded a free press by our Founding Fathers.  They recognized that our freedom would come under attack, they saw the press as having a vital role in warning of an overreaching and abusive government.

Few spectacles are more chilling these days than to watch as our press is virtually silent during press conferences with the President, or even his press Secretary, on issues across the board that are having long term impacts to Americans freedoms.

Some of the media remarks are so absurd and beyond belief in unadulterated adulation for a president that has barely taken office, yet has done considerable damage to Americas image and to freedoms image as well thus far, that you find yourself double checking the sources to make sure they are true!

I have come to the conclusion that this president has no intention of making the case for freedom, this president intends to make a case of government control over freedom, and the press has decided to aid and abet him in that effort.

So I would make this case.  We are not the “extremists” here. We who love freedom, we love liberty and we want our children and grandchildren to also have freedom and liberty are not any of the names or labels used to distort what we stand for.

We are doing what so many others have done throughout our great history.  We are following tradition, celebrating freedom,  and always doing our part to both preserve and protect it.

We have lost so many good men and women fighting for our country.  They vowed to protect and preserve our Constitution, the doctrine of freedom,  from all enemies foreign and domestic.

When will President Obama make the case for freedom?

I do not believe he ever will, or ever wanted to.

So everyday we must do it for ourselves!
